Audiobook warning

iLounge has reported that Apple are currently advising iTunes Store customers not to purchase audiobooks, as there have been some compatibility issues with iPods.
Audiobooks, including The Four Hour Week by Tim Ferriss and The Assault on Reason by Al Gore, appear to play correctly through iTunes, yet won’t play on an iPod. Apple are recommending that anyone who’s bought a faulty audiobook should contact them for a full refund.

Does anyone actually buy audiobooks? I just get them from my library and rip them from the CD's. Is that legal?
